Acceptable Use Policy

Acceptable Use Policy (AUP)

1. Purpose

This Acceptable Use Policy (hereinafter "the AUP") defines the rules that all TELES HOSTING Clients must follow when using hosting services, domain names, VPS, dedicated servers, reseller services, email, and any other provided service. The AUP is incorporated into the Terms and Conditions by reference and forms an integral part thereof.

TELES HOSTING operates from Cameroon and serves an African and international clientele. The AUP applies to all Clients, regardless of location, and takes into account the law applicable in the Client's country of establishment.

Any violation of the AUP may result in immediate suspension of the affected Service and all of the Client's Services, without notice or compensation, and independently of any legal proceedings.

2. Legal Framework

The AUP applies in accordance with Cameroonian law, notably:

  • Law No. 2010/021 of December 21, 2010 governing electronic commerce;
  • Law No. 2010/013 of December 29, 2010 on cybersecurity and the fight against cybercrime in Cameroon;
  • Law No. 2024/017 of December 23, 2024 on personal data protection;
  • the Cameroonian Penal Code;
  • international conventions ratified by Cameroon, notably the Budapest Convention on Cybercrime.

Also applicable are:

  • the law of the Client's country of establishment, particularly regarding cybercrime, consumer protection, and intellectual property;
  • ICANN rules and TLD registry policies for domain names;
  • acceptable use policies of partner datacenters and infrastructure providers.

3. Strictly Prohibited Activities

The following activities are strictly prohibited and result in immediate suspension without notice:

3.1 Illegal Activities

  • Hosting, distributing, or promoting illegal content in Cameroon, in the Client's country of origin, or in any country where the content is accessible, including: scam, fraud, forged documents, fake certificates, fake diplomas, fake driver's licenses, fake passports;
  • Sale or promotion of illegal substances (narcotics, unauthorized pharmaceuticals, counterfeit drugs);
  • Arms trafficking, terrorism financing, money laundering;
  • Content related to sexual exploitation, child pornography, or human trafficking;
  • Content inciting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, or disability;
  • Defamatory, insulting content, or content infringing on the privacy or honor of third parties.

3.2 Cybercrime and Attacks

  • Launching or facilitating distributed denial-of-service (DDoS) attacks;
  • Vulnerability scanning, intrusion, or attempted unauthorized access to third-party systems;
  • Hosting malware, ransomware, Trojans, rootkits, or any malicious code;
  • Hosting command-and-control (C2) servers for botnets;
  • Creating or operating botnets;
  • Phishing, vishing, smishing, or any form of identity theft;
  • Hosting phishing pages, fake banking sites, fake Mobile Money payment sites (MTN MoMo, Orange Money, Wave, Moov, etc.), fake Western Union, MoneyGram, RIA, or any other money transfer service sites;
  • Brute-force, credential stuffing, or dictionary attacks against third-party systems.

3.3 Spam and Email Abuse

  • Sending mass unsolicited emails (spam), including through third-party open relays;
  • Sending mass unsolicited SMS or WhatsApp, Telegram, or any other messaging platform messages;
  • Sender spoofing;
  • Hosting email address or phone number lists obtained without consent;
  • Email marketing without an unsubscribe mechanism, or without complying with opt-in rules.

3.4 Resource Abuse

  • Excessive resource consumption (CPU, RAM, bandwidth, I/O) to the point of degrading the service of other Clients, particularly on shared hosting plans;
  • Cryptocurrency mining on TELES HOSTING infrastructure without express authorization;
  • Running long processes, daemons, or unauthorized listening services on shared plans;
  • Storing files for mass distribution (alternative CDN, download mirror) without prior agreement.

3.5 Counterfeiting and Intellectual Property Infringement

  • Hosting infringing content (pirated software, movies, music, books, copyright-protected content);
  • Distributing pirated license keys, cracks, keygens;
  • Trademark, trade name, or domain name usurpation of a third party in bad faith (cybersquatting, typosquatting);
  • Unauthorized reproduction of third-party websites.

3.6 Impersonation and False Identity

  • Creating websites impersonating another company, government agency, bank, Mobile Money operator, money transfer service, or public figure;
  • Using false domain name registrant data (falsified WHOIS);
  • Creating fake delivery sites, fake package tracking sites, fake customer service sites.

3.7 Online Scams and Fraud

  • Scam sites of the "fake pets", "fake package delivery", "fake investment", "fake loans", "fake recruitment", "money recovery" (recovery scam) types;
  • Sites promising unrealistic gains, free gift cards, or fraudulent lotteries;
  • Phishing sites targeting Mobile Money, Orange Money, MTN MoMo, Wave, Moov Money, or any other African or international payment platform;
  • Pyramid schemes, Ponzi schemes, illegal MLM;
  • Fake dating sites, fake visa sites, fake immigration sites.

4. Client Responsibility

The Client is solely responsible for the content they host and the use made of the Services, including by their own users, subcontractors, or resellers. The Client undertakes to:

  • supervise all content and accounts created in their space;
  • keep installed software, CMS, and applications up to date (notably WordPress, Joomla, etc.);
  • use strong and unique passwords;
  • apply security updates promptly;
  • not share their credentials;
  • cooperate with TELES HOSTING in case of an abuse investigation.

For reseller accounts, the Client is responsible for compliance with the AUP by all of their own sub-clients. Any breach by a sub-client may result in suspension of the reseller account.

5. Abuse Reporting

Any abuse report, whether from a Client, a third party, or an authority, must be sent to abuse@teles-hosting.com indicating:

  • the affected domain or IP;
  • the nature of the abuse;
  • available evidence (screenshots, logs, URLs, timestamps).

TELES HOSTING undertakes to process serious reports (phishing, malware, child pornography, fraud) as a priority, within a maximum of [24] hours. Other reports are processed within a maximum of [72] hours.

6. Suspension Procedure

In case of a confirmed or suspected AUP violation:

  1. Serious abuse (phishing, malware, child pornography, fraud, DDoS attack, illegal content): immediate suspension, without notice. The Client is notified afterwards. Evidence is retained for legal purposes.
  2. Moderate abuse (spam, resource abuse, counterfeiting, inappropriate content): notification to the Client with a [48]-hour deadline to correct. Failing that, suspension.
  3. Recidivism: regardless of severity, recidivism results in termination of the Service and prohibition from subscribing to new Services.

In case of a requisition from a competent judicial or administrative authority, TELES HOSTING may be required to suspend a Service or transmit data in accordance with the law, without prior notification to the Client if the law prohibits it.

7. Evidence Retention

In case of serious abuse, TELES HOSTING retains logs, copies of incriminating files, and evidence for a period of [12] months, and makes them available to competent authorities upon requisition. The Client is informed that the retention of illegal content for evidentiary purposes is governed by law and does not constitute unlawful reproduction.

8. Reactivation

After suspension for abuse, reactivation of a Service is only possible after:

  • removal of the content or cessation of the illicit activity;
  • written commitment from the Client to comply with the AUP;
  • validation by TELES HOSTING.

TELES HOSTING reserves the right to refuse reactivation, particularly in case of recidivism, severity of the abuse, or risk to the integrity of the infrastructure.

9. Indemnification

The Client undertakes to indemnify TELES HOSTING against any conviction, costs, and damages resulting from an AUP violation attributable to them, including legal defense and assistance fees.

10. Amendments

TELES HOSTING reserves the right to modify this AUP at any time. Amendments take effect upon publication on the website.
