Domain Name Registration Agreement

1. Purpose

This Domain Name Registration Agreement (hereinafter "the Agreement") governs the relationship between TELES HOSTING (hereinafter "the Provider" or "we") and any natural or legal person (hereinafter "the Client", "the Registrant" or "you") ordering, registering, renewing, transferring, or managing a domain name via the website https://teles-hosting.com.

TELES HOSTING provides domain name registration, renewal, transfer, and management services, in compliance with the policies of ICANN and TLD registries.

This Agreement supplements the Terms and Conditions and the Acceptable Use Policy, which apply in full. In case of conflict between this Agreement and the Terms on a domain registration matter, this Agreement prevails.

2. Acceptance of ICANN and Registry Policies

By registering a domain name via TELES HOSTING, the Client agrees to be bound by the following policies, which prevail over this Agreement in case of contradiction:

  • the Registrar Agreement between the partner registrar and ICANN;
  • ICANN Consensus Policies, available at icann.org;
  • the Uniform Domain Name Dispute Resolution Policy (UDRP);
  • the Uniform Rapid Suspension (URS);
  • the ICANN Transfer Policy;
  • the Registry-Registrar Agreement and policies of the relevant TLD registry (e.g., .com, .net, .org, .store, .shop, etc.);
  • the WHOIS Accuracy Program Specification;
  • the ICANN Expiration, Redemption and Grace Period Policy.

The Client acknowledges that these policies may evolve and that amendments take effect upon publication by ICANN or the registry, without prior modification of this Agreement.

3. Registrant Eligibility

The Client declares:

  • to be a natural person at least 18 years of age, or a duly constituted legal entity;
  • to have the legal capacity to contract;
  • that the information provided for registration is accurate, complete, and up to date.

Certain TLDs are subject to eligibility restrictions (e.g., .gov, .edu, .museum, .aero, certain ccTLDs). The Client is responsible for verifying their eligibility before ordering. TELES HOSTING reserves the right to refuse or cancel a registration that does not comply with the registry's rules.

4. Registrant Information and WHOIS Data Accuracy

When registering a domain name, the Client must provide the following information, which will be transmitted to the registrar and the registry:

  • Registrant: name, organization, address, city, country, postal code, phone, email;
  • Administrative contact: name, address, phone, email;
  • Technical contact: name, address, phone, email;
  • Billing contact: name, address, phone, email.

The Client undertakes to provide accurate and truthful information. Providing false information, a fictitious address, an invalid phone number, or a non-functional email address constitutes a breach of this Agreement and ICANN policies, and may result in:

  • suspension of the domain name by the registry or registrar;
  • deletion of the domain name without refund;
  • sanctions from ICANN or the registry.

The Client must keep this information up to date throughout the registration period and notify any changes via the client area within [7] days.

4.1 ICANN Data Verification

In accordance with the WHOIS Accuracy Program Specification, the registrar is required to periodically verify Registrant data. If a verification fails (non-responding email, returned postal mail), the registrar may suspend the domain name after a notification period. TELES HOSTING cannot be held liable for suspensions related to inaccurate data attributable to the Client.

4.2 Privacy Protection (WHOIS Privacy)

TELES HOSTING offers, for eligible TLDs, a WHOIS Privacy service (WHOIS Privacy / ID Protection). This service masks the Registrant's personal information in the public WHOIS database, replacing it with the privacy service's information. The Registrant remains the legal owner of the domain name.

WHOIS privacy is not available for all TLDs (notably certain ccTLDs such as .us, .fr, .eu, .ch, .it which require the publication of registrant data). The Client is informed that the privacy protection may be lifted in case of UDRP proceedings, legal requisition, or abuse complaint.

5. Domain Name Ownership

The Client is the legal holder of the domain name for the registration period, subject to compliance with this Agreement and registry policies. TELES HOSTING acquires no ownership rights over the domain name.

The Client acknowledges that a domain name is a registration service and not an absolute property right. Registration grants the Registrant the right to use the domain name for the subscribed period, in compliance with the rights of third parties and applicable policies.

6. Duration, Renewal, and Expiration

6.1 Registration Period

The registration period of a domain name varies by TLD and product chosen (1 to 10 years for most gTLDs, variable duration for ccTLDs). The maximum duration is 10 years, in accordance with ICANN rules.

6.2 Automatic Renewal

Unless explicitly disabled by the Client, domain names are automatically renewed upon expiration. A renewal invoice is issued and notified by email before the expiration date. The Client may disable automatic renewal at any time from the client area.

6.3 Grace and Redemption Periods

Upon expiration of an unrenewed domain name, the following periods apply (in accordance with ICANN and registry policies):

These periods may vary by TLD. TELES HOSTING cannot be held liable for the loss of a domain name due to a renewal failure attributable to the Client, nor for recovery fees charged by the registry during the redemption period.

6.4 Expiration Notifications

TELES HOSTING sends expiration notifications by email on the following dates (in accordance with ICANN requirements):

  • 30 days before expiration;
  • 7 days before expiration;
  • 3 days before expiration;
  • 1 day before expiration.

It is the Client's responsibility to maintain a valid email address and to monitor these notifications. TELES HOSTING cannot be held liable for notifications not received due to an invalid email address, a full mailbox, or spam filtering.

7. Domain Name Transfers

7.1 Incoming Transfer (to TELES HOSTING)

The Client may transfer a domain name from another registrar to TELES HOSTING. The following conditions apply:

  • the domain must have been registered or transferred more than 60 days ago;
  • the domain must not be expired, in redemption, or pending delete;
  • the Client must obtain the authorization code (Auth-Info / EPP Code) from the losing registrar;
  • the domain must not be locked (ClientTransferProhibited status);
  • the Client must confirm the transfer via the confirmation email sent by the registrar.

A transfer typically includes a one-year extension. The transfer may take 5 to 7 days depending on the TLD.

7.2 Outgoing Transfer (from TELES HOSTING)

The Client may transfer a domain name to another registrar at any time, subject to the above conditions. The Client may obtain their Auth-Info code from the client area or by contacting support. TELES HOSTING does not charge for outgoing transfers and does not block transfers without legitimate cause.

In accordance with the ICANN Transfer Policy, TELES HOSTING may refuse a transfer in the following cases:

  • dispute over domain ownership;
  • non-payment of renewal fees;
  • domain locked due to fraud or abuse;
  • domain within the first 60 days after registration or previous transfer.

7.3 Transfer Between TELES HOSTING Accounts

The Client may transfer a domain name to another TELES HOSTING account (push) from the client area, subject to the recipient's agreement.

8. DNS and Nameserver Changes

The Client may change the nameservers (DNS) of their domains from the client area. Changes take effect within 24 to 48 hours depending on DNS propagation. TELES HOSTING provides default nameservers, but the Client may use external nameservers.

The Client may also create custom DNS records (A, AAAA, CNAME, MX, TXT, SRV) via the DNS management interface, subject to TLD technical limitations.

9. Disputes and Conflict Resolution

9.1 Uniform Domain Name Dispute Resolution Policy (UDRP)

Any domain name registered via TELES HOSTING is subject to the UDRP of ICANN. A third party who believes a domain name infringes their trademark rights may file a complaint with an ICANN-accredited dispute resolution provider (WIPO, NAF, ADNDRC, FORUM). TELES HOSTING does not intervene in these proceedings and implements the rendered decision.

9.2 Uniform Rapid Suspension (URS)

The URS procedure allows rapid suspension of a domain name in case of clear trademark infringement. The domain is suspended for the duration of the registration but is not transferred to the complainant.

9.3 Judicial Proceedings

The Client acknowledges that any judicial proceeding relating to a domain name may be brought before the competent courts. TELES HOSTING will implement any valid judicial or arbitral decision, including the transfer or deletion of the domain name.

9.4 Registrant Liability

The Client is solely responsible for the choice of their domain name and any infringement of third-party rights (trademark, trade name, personal name, copyright). TELES HOSTING does not verify the legitimacy of ordered domain names and cannot be held liable for disputes. The Client undertakes to indemnify TELES HOSTING against any claim related to a domain name they have registered.

10. Prohibited Uses of Domain Names

In addition to the prohibitions set forth in the AUP, the following uses are specifically prohibited for domain names registered via TELES HOSTING:

  • Cybersquatting: registering a domain name corresponding to a third party's trademark or trade name, without right or legitimate interest;
  • Typosquatting: registering a spelling variant of a known domain name to capture traffic;
  • Domain tasting / domain kiting: mass-registering domains for testing, followed by systematic deletion;
  • False WHOIS: registering with false registrant information;
  • Phishing by domain name: registering a domain name imitating a brand, bank, Mobile Money operator, or money transfer service for phishing purposes;
  • Malware hosting: using the domain to host malware, C2, or phishing pages;
  • Spam: using the domain to send mass unsolicited emails.

Any breach results in suspension of the domain name and potentially all of the Client's Services, in accordance with the AUP.

11. Domain Name Deletion

The Client may request early deletion of a domain name from the client area. Deletion is irreversible and does not entitle to any refund. The domain enters the pending delete period and will be released by the registry.

TELES HOSTING may proceed with the deletion of a domain name in the following cases:

  • confirmed false WHOIS, uncorrected after notification;
  • violation of the AUP or this Agreement;
  • decision by ICANN, the registry, or a judicial authority;
  • non-payment of renewal fees beyond the grace period.

12. Pricing and Refunds

Registration, renewal, and transfer prices are displayed on the website and vary by TLD. Prices may be changed by registries without notice; TELES HOSTING will pass on these changes.

Domain name registration fees are non-refundable, except in case of cancellation by TELES HOSTING before the actual registration with the registry.

Redemption period recovery fees are set by the registry and are non-refundable.

13. Limitation of Liability

TELES HOSTING depends on registrars and registries for the execution of registrations. TELES HOSTING cannot be held liable for:

  • failures, delays, or errors attributable to the partner registrar or registry;
  • deletions or suspensions imposed by ICANN or the registry;
  • loss of domain names due to a renewal failure attributable to the Client;
  • intellectual property disputes (UDRP, URS, judicial proceedings);
  • temporary or permanent unavailability of a TLD.

The liability of TELES HOSTING for domain names is capped at the amount paid by the Client for the affected domain over the last [12] months.

14. Governing Law

This Agreement is governed by Cameroonian law, without prejudice to the mandatory policies of ICANN and registries, which prevail on domain registration matters. In case of dispute, the parties shall endeavor to find an amicable solution. Failing that, the competent Cameroonian courts shall have jurisdiction.

15. Amendments

TELES HOSTING reserves the right to modify this Agreement at any time. Amendments take effect upon publication on the website. Registered domain names retain the terms applicable on the date of registration until their next renewal.
